License request

The HP OpenVMS Educational License Program is available to all educational institutions around the world. This program provides easy access to HP OpenVMS base operating system licenses and product authorization keys (PAKs) to over 100 layered products.

Participation in the HP OpenVMS Educational License Program requires agreement with the terms and conditions below.

Terms and conditions

Administration terms
A registration number for this program is only issued to an educational institution and may only be provided to students and employees of the institution. Those at the educational institution to whom the registration number is distributed must agree to the following in order to access license keys for any of the software products covered by this program.

QUANTITY: 1 Individual

This document is the legal agreement governing your use of the Software and associated License Keys.

OpenVMS EDUCATIONAL LICENSE TERMS

  1. GRANT
    Upon agreement to these terms, Hewlett-Packard Company ("HP") grants you a limited right to use the Software Program Version (the "Software") specified above by a single individual. The Software may be used on a single computer solely for individual and personal "technology enthusiast" purposes, personal education and study (including educational-related research), or administrative use in support of the educational institution. It may not be used for any commercial or business purpose, whether "for profit" or "not for profit." Any work performed or produced as a result of use of this Software cannot be performed or produced for the benefit of other parties for a fee, compensation or any other reimbursement or remuneration. This license is granted to a named individual at an educational institution and not to any public, private or governmental institution or entity. However, the Software may be copied and used on multiple computers or multiple accounts on the same computer, provided, in either case, that such computer or computers are under your control in a classroom environment, including use by multiple students who have been provided with a copy of and agreed to these License Terms solely for instructional purposes. By way of clarification, any use of the Software by such students shall be under your license and no additional license is hereby granted by HP to such students. Your initial and ongoing eligibility for this license is subject to review by HP, and HP may terminate this license at any time upon thirty days written notice. YOUR RIGHTS TO USE THE SOFTWARE AND THE LICENSE KEY TERMINATE ON THE AUGUST 31st FOLLOWING THE DATE OF THE LICENSE GRANT. YOUR LICENSE KEY WILL EXPIRE ON THIS DATE. You may copy the Software into the local memory or storage device of a single computer, and you may make one archival or back-up copy of the Software. This license, associated software and license key may not be assigned or transferred to another party, and any such attempted assignment or transfer will be null and void. HP may terminate this license in the event of any such attempted assignment or transfer. This license does not entitle you to receive upgrades, updates or technical support.

  2. COPYRIGHT
    The Software is protected by copyright laws and international treaties. Your use of the Software and associated documentation is subject to the applicable copyright laws and the express rights and restrictions of this License Agreement. This License Agreement confers no title or ownership and is not a sale of any rights in the Software.

  3. RESTRICTIONS
    You may not rent, lease, or otherwise transfer the Software except as expressly authorized in this License Agreement. You may not make the Software available over the internet, any public or distributed network or similar networking technology. You may not modify or make inoperable the license key or license management software, if provided. You may not remove any copyright, trademark, or other proprietary notices from the Software or the media. You may not reverse engineer, decompile, or disassemble the Software, except to the extent HP cannot prohibit such acts by law. You may not export or re-export this software or any copy or adaptation in violation of any applicable laws or regulations.

DISCLAIMER OF WARRANTY

TO THE EXTENT ALLOWED BY LOCAL LAW, THIS SOFTWARE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. HP SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, NON-INFRINGEMENT, TITLE, ACCURACY OF INFORMATIONAL CONTENT, AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE RESULLTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY HP OR HP'S AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY. Some jurisdictions do not allow exclusions of implied warranties or conditions, so the above exclusion may not apply to you to the extent prohibited by such local laws. You may have other rights that vary from country to country, state to state, or province to province.

LIMITATION OF LIABILITY

EXCEPT TO THE EXTENT PROHIBITED BY LOCAL LAW, IN NO EVENT WILL HP OR ITS SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR SUPPLIERS BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES (INCLUDING LOST PROFIT, LOST DATA, OR DOWNTIME COSTS), ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SOFTWARE, WHETHER BASED IN WARRANTY, CONTRACT, TORT OR OTHER LEGAL THEORY, AND WHETHER OR NOT HP WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Your use of the Software is entirely at your own risk. Should the Software prove defective, you assume the entire cost of all service, repair or correction. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitation may not apply to you to the extent prohibited by such local laws.

GENERAL

You are responsible for compliance with all applicable export or re-export control laws and regulations if you export the Software. This Agreement is governed by and is to be construed under the laws of the State of California, without regard to conflict of laws principles.
